1. Approval

To use or view any of the features presented on the Mew Website (inc. all features, software, products and/or services), one must approve and agree to Kootek Inc.’s “Terms & Conditions”, “Privacy Policy” & “Copyright” for Mew Websites.  By clicking on the accept button during registration, you are agreeing with everything written in the 3 forms. Also, even if you are not registered to Mew Websites, by viewing you are acknowledging to accept these terms.

When there are any substantial changes within any of our policies or terms, we will notify out registered users by Email, but we ask our users to check these forms in relatively frequent occasions to make sure of any minor updates. Kootek Inc. has the right and jurisdiction to change all services, terms and policies at any time. Users agree to the restrictions of these changes.  These terms do not grant any benefits or rights to a third party.


2. Kootek Inc.’s Response

If Kootek Inc. considers a certain activity within Mew Websites to be profound, even though the activity is not strictly written out in these Terms, they have the right to take the necessary measures (account or article deletion without user approval etc.) to react to the situation, and all users agree to this right.


3. Mew Account

Within all Mew Websites, the amount of activity that can be done without account creation is limited to viewing. To use any of the features of the Website, one must register and log in. Kootek Inc. does not approve the use of any account other than that of which is yours.

Kootek Inc. allows users to only write correct privacy information during the registration process. All activity within one’s user account is regarded as activity done by the account owner and they must take all responsibilities for all actions. One must also keep their password in a safe location. If the user loses the password there is no responsibility for Kootek Inc. Nor will they take any responsibility for any loss resulting from unauthorized use. The user must take all responsibility for any loss resulting from unauthorized use.

The user must notify Kootek Inc. if they commit any violation to these terms or illegal activities. Also one must notify Kootek Inc. for any violation to these terms or illegal activities seen on the site by any user. If Kootek Inc. notices any violation to these terms or illegal activities by users, they may delete the users account without any notification to the user. This means that the user will not be able to use Mew Websites any longer, and their Email will not be able to be used for new registrations.


4. Services

Even when one does not own an account in Mew Websites, by viewing any of the Mew associated websites, they agree to Kootek Inc.’s “Terms & Conditions”, “Privacy Policy” & “Copyright” for Mew Websites. Mew Websites have links that are connected to third party websites or content which has no association with Kootek Inc. In these cases all users must acknowledge and accept that Kootek Inc. has no responsibility for any of the content, Privacy Policy etc. found in these links, as Kootek Inc. does not maintain or administer any of them.

By accepting these Terms, all users agree to not reproduce any of the material found on Mew Websites. All persons who view Mew Websites accept that they must contact Kootek Inc. to commercially use any of the material presented on Mew Website. Thus, the use of any material for promotional or sales purposes other than that of products in relation to Kootek Inc. is not allowed. Kootek Inc. has the right to decide which activity is considered to be commercial or not allowed.

Mew website does not confirm or edit any of the material on any third party source. Therefore, by using Mew Website, one agrees to exempt Kootek Inc. from any liabilities arising from these third party sources.


5. Article Content

All the rights including copyrights of the content a user uploads on Mew Websites will be owned by Kootek Inc.

Kootek Inc. does not allow the commercial reuse of any article content present on Mew Websites. Kootek Inc. allows the reuse is for noon-commercial purposes, as long as the person(s) who distributes the information elsewhere quotes Mew websites.

Mew websites do not allow the uploading of contents which may disturb social customs, thus meaning the uploading of illegal or sexual, violent, offensive content legal (especially with images and videos), which are only legal for persons 18 or over in Japan. When such contents are uploaded, they will be deleted as soon as Kootek Inc. recognizes them.

Kootek Inc. has the right to edit and/or delete any content uploaded by users on Mew websites. Kootek Inc. will not edit any of the content more than necessary, but if they recognize any problems, they may edit or delete the content without notifying the original uploader.

When Kootek Inc. edits or deletes any content uploaded by those other than in relation with Kootek Inc. they will inform the user in association with the edited/deleted article. There is a chance that the notification Email may take time or may not be delivered. Please be advised.

The information present on Mew websites is collected from numerous personal users. Therefore Kootek Inc. does not promise the accuracy of the information. Kootek Inc. is not responsible for any problems or losses which may occur due to the lack of these accuracies. We also do not take any responsibilities for any negative, indecent or offensive content and the resulting effects of these contents that the viewers may attend to during their time on Mew websites.

Users will not do anything which interferes with other user’s activities or Kootek Inc.’s service in Mew websites.

Koote Inc. forbids the duplication, transfer or abuse of anything in relation to Mew Websites.


6. Prohibitions

The following is a short list of activities and content which are not allowed on Mew websites.

Actions which 1) violate Japanese law, or encourages, enforces or assists illegal activity, 2) give a great deal of stress on Kootek Inc.’s web servers, 3) hinder the operation of Mew Websites, 4) are considered as violation of Kootek Inc.’s “Terms”, 5) interfere with other Mew Website users, 6) violated election laws (pre-election campaign, campaign, and the like), 7) violate others honor, privacy, portrait rights, social trust, publicity rights, copyrights and other intellectual property rights, (which includes everything stipulated and authorized by Japanese law), 8)  slander, threat, harassment towards other users, 9) are considered as ageism, racism, sexism, or religious discrimination, 10) assist/encourage/recruits suicide, mass suicide, self-harm, drug use or illegal activities, 11) assist people to meet up for purposes of sexual or indecent activities, 12) may lead to sex, pornography, violence or discomfort for others, 13) lead Mew Websites to pornographic content of any kind, 14) transfer money using any feature, source or content of Mew websites without Kootek Inc.’s permission, 15) advertise, spam/chain mail, or send viruses/malwares,16) use others (inc organizations) names and lead to identity theft, 17) may be considered morally or socially unacceptable.

7. Transfer

Kootek Inc. forbids the transfer or reassignment of all contents, services and conditions of Mew Websites. However, Kootek Inc. has the rights to transfer them with no regulations.


8. Acceptance of terms of services

All users must be either an adult over the age of 20, or have the consent of a guardian with legal effect.  Also, all users must have the ability to understand and comply with these terms.


9. Responsibility and Accountability in Use

When a person uses Mew websites, they understand that they are acting within the confines of their own risk. Thus meaning that all events and incidents that may occur within Mew websites has no direct connection in responsibility or guarantee with Kootek Inc. For example: 1) accuracy of contents, 2) accidents caused by the use of the website, 3) the websites suspension or closure, 4) bugs and viruses sent from third parties, 5) The content or safety of other third party websites that Mew Website is linked to. All persons who use Mew websites understand that Kootek Inc. is not responsible or accountable for all services, contents, usage rules, or any illegal, rule violating, or offensive activities on Mew websites.


10. User’s Responsibilities

Mew Websites are a multi-user, information sharing community based websites. To improve the websites and its services, user participation is necessary. If any persons using Mew Websites notices any irregular activity that may violate the rules presented on “Terms & Conditions”, “Privacy Policy” and “Copyright”, or may be socially/legally illegitimate, they have the responsibility to notify the staff of Kootek Inc. If the irregular activities are found in the content uploaded by users, there will be a “Flagging” function which allows users to notify us without using Email. 11. General

Kootek Inc. is based in Tokyo, Japan. Therefore all sites created by Kootek Inc. (including Mew Websites) are under the jurisdiction of Japanese law, and all people using websites created by Kootek Inc. must follow these jurisdictions. If there are any legal problems about Kootek Inc. or Mew Websites, it must be addressed at the Tokyo District Court.

Kootek Inc. does not take any responsibility for the content uploaded by users, and any problems which may arise in this matter must be worked out between the users or persons.

Even if there is no direct enforcement power in any of Kootek Inc.’s services or Terms, it does not affect any other documentation by Kootek Inc. such as out “Privacy Policy”.
